1. Interpretation
    1. In these Terms and Conditions (“these conditions”), the following terms shall have the following meanings: ‘Registration Form’ the registration form available for completion online or to download via The SSC (a club for the youth of Scotland) website; ‘Camper Information Form’ the form used to gather information on each camper, available for completion online or to download via The SSC (a club for the youth of Scotland) website; ‘Camp’ the camp, which the Camper is attending, as set out in the Registration Form; ‘Camper’ the child or children who will be attending the Camp as specified in the Registration Form; ‘The SSC’ The SSC (a club for the youth of Scotland) office address; SSC Office, 40 Howe Street, Edinburgh, EH3 6TH. Camp site address; B847, Pitlochry, PH18 5UE. ‘Deposit’ the deposit specified on The SSC (a club for the youth of Scotland) website or published literature relating to the Services; ‘Fees’ the fees shown on The SSC (a club for the youth of Scotland) website or published literature relating to the Services; ‘Full Fee Date’ the date specified in the ‘dates & prices’ section of the website or published literature relating to the Services, by which the fees relating to the Camp must be received; ‘Location’ the location of the Camp (including travelling to and from the Location); B847, Pitlochry, PH18 5UE ‘Services’ the provision of the Camp for the Camper by The SSC (a club for the youth of Scotland); ‘Officer’ An SSC member aged over 18 working on Camp as a volunteer and therefore responsible for care and orchestration of Campers and Services. All Officers at Camp hold PVG’s with Disclosure Scotland. ‘you’ and ‘your’ the Camper’s parent(s) or guardian(s) as specified in “Parent/Guardian” section on the Registration Form.
    2. The headings in these Conditions are for convenience only and shall not affect their interpretation.
  2. Supply of Services
    1. The SSC shall provide the Services to the Camper subject to these Conditions. By booking and paying the deposit you agree on behalf of yourself and the Camper to be bound by these Conditions. These Conditions constitute the entire agreement between The SSC and you/ the Camper and may not be varied except in writing by the Organiser or Committee member of The SSC.
    2. Bookings are accepted at the discretion of The SSC and are not transferable.
    3. You shall fully complete the Registration Form and at your own expenses supply THE SSC with all necessary and other information required by The SSC in connection with the Services.
    4. The SSC may correct any typographical or other errors or omissions in any of The SSC material relating to the provision of the Services without incurring any liability to you.
  3. Payment of Fees
    1. You shall pay The SSC the Fees and any additional sums which are agreed between you and The SSC for the provision of the Services.
    2. Subject to the paragraph 3.5 below, the Deposit must be remitted together with the Registration Form. The Deposit is NOT refundable unless your booking is not accepted by THE SSC. No booking is valid until payment has been received, whether bank transfer or card/ cheque.
    3. On acceptance of your booking, The SSC will issue an invoice or Confirmation Letter for the balance of the Fees (the ‘Balance’)
    4. The Full Fee Date for the balance of Camp Fees can be found on the website or published literature relating to Services. After this date full payment is due at time of registration. If The SSC does not receive the balance by the Full Fee Date, a late fee of £15 will be charged to you. In the event of termination (and in accordance with paragraph 3.2 above), the Deposit will not be refunded. Payment Includes: accommodation, food, supervision, instruction, entertainment, activities and airport/ train station pick up/ drop off within stated time frames. Not Included: • Transport on Buses (additional £30 fee) • Pocket money • Souvenirs.
    5. Where a Registration Form is received by The SSC after the Full Fee Date, it must be accompanied by the Full Fees. On acceptance of such as Booking, The SSC will issue a confirmation.
    6. The SSC shall not be responsible for any cash payment unless it is handed personally to an Officer of The SSC
    7. All cheques must be payable to “SSC (a club for the youth of Scotland) ” (unless otherwise requested by The SSC).
  4. Cancellation
    1. If you wish to cancel a Camp booking for any reason, you must do so in writing to The SSC. Cancellation may be done via email. Please email office@thessc.org. The Camp registration may be cancelled before July 1st thereafter the outstanding fees become due and payable. If a camper must cancel for medical reasons, a full refund of the balance will be reimbursed on receipt of a doctors certificate. See Paragraph 15 for further details. The SSC reserves the right to apply the following cancellation charges (in addition to retention of the Deposit pursuant to clause 4.2);
    2. In the event that a Camp booking is cancelled by you at any time and for any reason, the deposit will be forfeited by you.
    3. If for any reason, the Camp is cancelled by The SSC, the total liability of The SSC will not exceed that proportion of the Fees The SSC have actually received.
  5. Rules, Regulations and your Liability
    1. You agree to be wholly liable for any and all actions and/or omissions of the Camper. Without prejudice to the generality of the foregoing, you shall be liable for any liability, financial or otherwise, or injury or damage to property caused by the Camper whilst at the Location, and shall fully indemnify The SSC, their agents, contractors and/ or employees for any loss, damage, costs or expenses resulting from such liability, injury or damage.
    2. THE SSC reserves the right to make rules and regulations relating to the Camper’s participation in the Camp (‘Camper Code of Conduct’). The Camper Code of Conduct forms part of these Conditions and will be notified to the Camper at the Location or earlier.
    3. Any failure by the Camper to adhere to the Camper Code of Conduct may result in his/ her participation at the Camp being terminated forthwith without refund and in such event the Camper may be sent home at your expense.
    4. Without prejudice to paragraph 5.3 above, The SSC reserves the right to withdraw the Camper from any activity at any time on the grounds of safety or unsuitability.
    5. We are sensitive to certain allergens but cannot guarantee their exclusion from the Camp.
  6. Liability
    1. Except in respect of death or personal injury caused by The SSC negligence, The SSC shall not be liable to you or the Camper by reason of any representation (unless fraudulent) or any implied warranty, conditions or other term or any duty at common law or under the express terms of this Agreement for any loss of profit or any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by or negligent or the negligence of our Officers, or Committee Members or otherwise) which arise out of or in connection with the provision of the Services or their use by you or the Camper, and our entire liability under or in connection with this Agreement shall not exceed the amount of our Fees for the provision of the Services.
    2. Where The SSC provides, in connection with the provision of the Services, any goods or equipment or services supplied by a third party, The SSC does not give any warranty, guarantee or other terms as to their quality, fitness for purpose, performance or otherwise.
    3. The SSC shall have no liability to the Camper for any loss, damage, costs, expenses or other claims for compensation arising from any instructions supplied by you which are incomplete, incorrect, inaccurate or illegible, or arising from the Camper’s late arrival or non-arrival, or any other fault of you or the Camper.
    4. The SSC shall not be liable to you or be deemed to be in breach of the contract by reason of any delay in performing, or any failure to perform, any of The SSC obligations in relation to the Services, if the delay or failure was due to any cause beyond The SSCs reasonable control.
    5. We advise you to take out travel insurance covering you against cancellation, curtailment, personal liability, personal accident and lost property.
    6. The SSC reserves the right to alter programmes, activities, itineraries, excursions, premises and personnel as it thinks fit and without notice.
    7. The SSC will not be bound by any statement unless it is in writing and authorised by the Chair of The SSC.
  7. Travel and Transport
    1. All Campers arriving and departing from Edinburgh Airport on the stated dates will be transferred to and from the Location free of charge providing Campers arrive within the designated collection times.
    2. Camp must receive all travel information by July 1st. Open returns cannot be accepted, please book a return ticket on the stated arrival and departure dates.
    3. Transport vehicles provided by The SSC, coaches and mini buses are hired externally. Drivers are licensed appropriately and reserve the right to frequent breaks. Agreed pick up and drop off times and locations must be adhered to by you. If you fail to alert us to a Camper requiring transport from The SSC in the agreed time frame it is not our responsibility if there is not enough space on the bus for the Camper. The SSC will attempt to rectify any issues as such but reserve the right to charge a £30 bus fee if not paid and to refuse transportation if safe numbers of passengers and luggage is exceeded.
    4. Where appropriate The SSC will arrange for transport by car with our Officers. In this instance the ratio must be 2:1 either Camper or Officer.
  8. Medical and Behavioural
    1. Any medical or behavioural problems of the Camper know to you must be notified to The SSC in writing on the Camper Information Form, and in any event prior to the commencement of the Camp. The SSC reserve the right not to accept your Booking on the grounds that any such medical or behavioural problems are not conducive to the Camper’s or other ‘campers’ participation in the Camp.
    2. In the event that the Camper becomes ill or incapacitated during the Camp, you agree to medical treatment being given to the Camper if required in accordance with the recommendations of a qualified medical practitioner, including the administration of a general anasethetic and to surgical operations in case of emergency. Permission is also granted for routine medical care for the Camper by The SSC personnel of any prescribed medication which the Camper brings to the Camp or which is prescribed while at Camp or the use of over the counter medication when needed.
    3. If the Camper becomes ill or comes into contact with any contagious or infectious disease during the 21 days prior to the commencement of the Camp, you must immediately notify The SSC in writing and provide a medical ceriticate from the Camper’s doctor giving approval for the Camper to participate in the Camp.
    4. It is your and the Campers responsibility to help THE SSC prevent the spread of infectious diseases.
    5. On request, you will provide a doctor’s letter stating a Campers suitability to participate in Camp.
    6. It is your responsibility to tell The SSC prior to Camp of any issue or condition that may affect their stay at Camp. These include but are not limited to ADHD, SEN, medical, languages, disability, diet, behavioural/ social issues, child’s history.
  9. Jewellery, Electronics, Valuables and Lost Property
    1. The SSC will not be liable for any item of jewellery, electronics or valuable property brought to the Location by the Campers.
    2. The SSC will not be responsible for any property left at the Location (by the Camper or otherwise), and may dispose of any such property if not claimed and collected by you.
    3. The SSC provides a Bank service whereby property of Campers is locked away and kept track of by Officers in charge of the Bank. If the Camper does not use this Service, which is recommended, The SSC is not liable for any lost item of jewellery, electronics or valuable property brought to the Location by the Campers.
  10. Personal Searches
    1. The SSC reserves the right to search the bags and other personal property of all Campers in appropriate circumstances.
  11. Publicity
    1. You acknowledge that The SSC may use for publicity purposes and without prior notification any photograph or video taken of the Camper at the Location, and any statement (whether written or oral) made by you or the Camper.
    2. If you do not wish any Camper to be photographed etc you must write to office@thessc.org to inform us.
  12. Smoking, Alcohol and Drugs
    1. Possession and consumption of alcohol, tobacco or drugs by the Campers at Camp are NOT PERMITTED UNDER ANY CIRCUMSTANCES. Please note that if the camper does not adhere to this condition, he/she will be removed from Camp in accordance with paragraph 5.3 of these Conditions.
  13. Child Protection/ Safeguarding
    1. The SSC will contact Local Safeguarding Children’s board if we suspect abuse or in an event of a disclosure.
    2. It is your responsibility to give The SSC information (name, address and other contact details) of every person who is a parent and/or carer and/or has parental responsibilities for the Camper. It is also your responsibility to tell us who the Camper normally lives with.
  14. Force Majeure
    1. We shall not be liable for any delay in performing or failure to perform any obligation (including to action any alteration or cancellation) due to any case beyond our reasonable control including lock-outs, strikes, shortages of personnel, labour disputes, war, riot, act of God, civil commotion, terrorism, malicious damage, threats to safety, compliance with any law or governmental order, rule, regulation or direction, accident, environmental contamination, pandemic outbreak of disease, breakdown of plant or machinery, fire, flood, storn, difficulty or increased expense in obtaining workmen, materials, goods or raw materials in connection with the performance of this agreement. No refund will be made, except at The SSC discretion.
  15. Refunds
    1. Deposits are never refunded.
    2. At the discretion of The SSC, we may offer a discount for another event if a camper has left early through illness, or similar reasons.
    3. Partial refunds are available on a sliding scale from the payment deadline date until the start of camp, as follows: If we receive notice of cancellation 4 weeks before the start of camp, you will receive a 70% refund If we receive notice of cancellation 2 weeks before the start of camp, you will receive a 25% refund If we receive notice of cancellation 1 weeks before the start of camp, you will receive a 0% refund
    4. If your child is scheduled to attend one evet and is unable to, The SSC can attempt to switch events at no extra cost to you.
  16. General
    1. If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Conditions and the remainder of the provision in question shall not be affected.
    2. This agreement is governed by the laws of Scotland and the parties submit to the exclusive jurisdiction of the Scottish Courts
